BY CONTINUING TO USE THIS WEB SITE AND/OR ORDER PRODUCTS, YOU REPRESENT TO US THAT YOU HAVE READ AND UNDERSTAND THIS POLICY. THE FOLLOWING IS A LEGALLY BINDING CONTRACT BETWEEN YOU AND FREE ENERGY INSTITUTE, S.A., AND GOVERNS YOUR USE OF THIS WEB SITE, ITS CONTENT, AND RELATED LINKS. THIS POLICY IS AN INTEGRAL DOCUMENT WITH ALL OF ITS SECTIONS GIVEN BELOW.
BY CONTINUING TO USE THIS WEB SITE, YOU ARE ACCEPTING AND AGREEING TO ABIDE BY ALL OF THIS POLICY. YOU ALSO AGREE TO ACCEPT AN ELECTRONIC RECORD OF THIS POLICY, AND ALL OTHER TRANSACTIONS AS FULL SATISFACTION THAT THEY BE PROVIDED TO YOU IN WRITING. IF YOU DO NOT AGREE WITH ANY OF THIS POLICY OR FIND ANY PART OF THIS POLICY UNACCEPTABLE, SIMPLY LEAVE THIS WEB SITE WITHOUT FURTHER USE AND DO NOT ORDER PRODUCTS OR SERVICES FROM OUR CATALOG.
This Shipping, Refunds & Returns Policy (hereafter "Policy") complements, and is governed by, our Terms and Conditions Agreement. This Policy applies to use of the web site located at http://www.Water4Gas.com (the "Site"). The Site is the property of Free Energy Institute, S.A. (hereafter "The Company"). Before you make any purchases or participate in commerce, you must first establish the proper type of user account (hereafter "My Account").
The Company reserves the right, at its sole discretion, to change, add or remove portions of this Policy, at any time. It is your responsibility to check this Policy each time before using the Site. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. You agree that all subsequent purchases by you will be subject to this Policy, which shall apply until we post a modified Policy and then in accordance with such modified Policy. As long as you comply with this Policy and any such modifications, the Company grants you ("End User") a personal, non-exclusive, non-transferable, non-sublicensable, limited privilege to enter and use the Site.
SECTION A: DEFINITIONS
- Provider: Any person or company who sells bulk or retail quantities of consumer products via the Site. When you order a product or service from the Site, YOUR ORDER WILL BE FULFILLED BY THE PROVIDER WHO OFFERED THAT PRODUCT OR SERVICE. Note that the shopping cart is integral and lets you order products from multiple Providers, who may be located in different locations around the world. Providers are not called "sellers" or "vendors" or "merchants" because the only seller on the Site is the Company - however the Providers are those who PROVIDE the products. A provider may or may not be the original manufacturer of the products being offered by him or her.
- User: Any registered user (Customer, Provider or Partner) who uses or has used the Site to buy, sell or promote products and/or services.
- Consumer: Anyone who consumes or uses products or services from the Site, whether he or she is or isn't a registered User.
- Digital Download: A digital product (usually for sale) such as e-Book, software or video.
SECTION B: SHIPPING AND DELIVERY
1) CUSTOMERS – GENERAL:
- The Company does not have central warehouses. All goods purchased sold by the Company are provided by one or more Providers. When you order a product or service from the Site, your order will be fulfilled by the Provider who offered that product or service. Note that the shopping cart is integral and lets you order products from multiple Providers, who may be located in different locations around the world. Products you order will be shipped from the relevant Provider.
- With every shipment, the Provider is obliged to provide the Customer with a SHIPPING ADDRESS, to which returns may be made.
- It is the responsibility of the Customer to ensure the address entered for delivery is correct and that someone will be at the destination to accept the mail when it arrives or that your mail carrier will know how to handle your mail. If your package is returned to us due to a delivery failure you will be responsible for the shipping charges. If you wish for us to attempt shipping the package again you will be responsible for the new postage fees. There is a 15% restocking fee for all items that are returned in the mail that are not reshipped.
- All orders may take up to a three (3) business days for processing before being mailed.
2) CUSTOMERS – INTERNATIONAL ORDERS:
- All Customers who order from a Provider located outside of their country are responsible to know their countries customs regulations in regards to the importation of our products. Although we do our best to get your order to you as fast as possible, we can not guarantee that your customs officials will not delay the delivery of your package while inspecting it.
3) PROVIDERS:
- In order to register as a Provider with the Company, you must provide a valid SHIPPING ADDRESS. That address will be used by the Customer to return any faulty merchandise. The address must be a real location where returned merchandise can be delivered and promptly delivered to you so you can handle the return including notifying the Company if a Refund needs to be issued.
- In case of any changes to the SHIPPING ADDRESS of the Provider, it is the responsibility of the Provider to (1) login to his User Account and update the address, and (2) inform any Customers who may be eligible for returns of the new or applicable address.
- All sales must be made from existing stock and orders must be shipped to the Customer within three (3) business days.
SECTION C: RETURNS
1) GENERAL:
- NEVER SEND GOODS OF ANY SORT TO THE COMPANY – THE COMPANY’S ADDRESS IS NOT A WAREHOUSE NOR IS IT A SERVICE STATION FOR ANY MERCHANDISE BEING SOLD ON THE SITE. RETURNS MUST BE MADE TO THE SHIPPING ADDRESS PROVIDED BY THE PROVIDER WHO HAS SENT YOU THE ITEMS.
- You may return new, unopened items sold and fulfilled by any Provider within 30 days of delivery for a full refund. Items should be returned in their original product packaging, to the original Provider who has sent you the item or items. The Customer will be responsible for shipping charges in both directions.
2) UNDELIVERED MAIL:
- If your package is returned to us due to a delivery failure you will be responsible for the shipping charges. If you wish for us to attempt shipping the package again you will be responsible for the new postage fees. There is a 15% restocking fee for all items that are returned in the mail that are not reshipped.
3) DAMAGED ITEMS:
- If you have a problem with your order when it arrives, you have 3 days from the date of delivery to notify the Provider of any product defect or problem and arrange for a replacement and return of the damaged item. If the item is not returned within 10 days of this notification we can not accept the returned items. When returning damaged items please include the original packaging.
SECTION D: CALCULATING YOUR REFUND
The following conditions and exceptions apply.
1) PARTIAL REFUNDS:
- Any opened computer returned within 30 days of delivery: 85% of item's price.
- Any unopened media item or non-media item in original condition that is returned more than 30 days after delivery: 80% of item's price.
- Any printed book that has obvious signs of use: 50% of item's price.
- Any CD, DVD or similar media that has been opened (taken out of its plastic wrap): 50% of item's price.
- Any item that is not in its original condition, is damaged, or is missing parts for reasons not due to our error: up to 50% of item's price.
2) FULL REFUNDS:
- Any digital product (download) may be refunded, upon written request to our Help Center, within 60 days of delivery.
SECTION E: RECEIVING A REFUND
We'll issue a refund after we receive a return notice from the Provider and process your return.
If you are due a refund for non-returnable items, such as downloadable items, we'll issue a refund when you contact us.
This time period includes:
- 5 to 10 business days for us to receive your return notice from the Provider
- 3 to 5 business days for us to process your return
- The time it takes your bank or PayPal account to process our refund request.
We'll notify you via e-mail of your refund once we've processed your return.
You can view completed returns and refunds in your Customer login page. If the return or refund does not appear in your page within 4 weeks from the day you shipped your return, please contact our Help Center.
SECTION F: NON-RETURNABLE ITEMS
We do not accept returns of the following items:
- Any product missing the original paperwork, original packaging or any other major item(s)
- Gift cards
- Items purchased from sellers other than the Company’s Providers (such as third-party advertisers who may have displayed a banner on our Web Site)
SECTION G: EXCHANGES
- If you received a faulty item and need to exchange it for the same item, visit our Help Center to request a replacement. If you would like to exchange an item for a different one, please return the original item as outlined in this Policy (you will be refunded your original purchase price once we receive and process the item) and place another order for the item you wish to purchase. You do not have to wait for us to receive the original item before placing the new order.
- Please note that it takes us 5 to 10 business days for us to receive your return notice from the Provider, and 3 to 5 business days to process your return.
SECTION H: ITEMS PURCHASED FROM PROVIDERS
- As the Company’s Web site offers items for sale MADE AND SHIPPED BY REGISTERED PROVIDERS, it is important in the returns process to know who is the Provider whose item or items you have purchased. Your order may contain items from different Providers.
- If you have not received the refund within 4 weeks of sending your order back, please contact the Provider. If the Provider does not respond to your concerns, please contact our Help Center and we will handle the issue.
- Visit your Customer account page (login with your username and password) to view the Provider's information and general information about your order.
- The Company is not responsible for purchases made from third-party sellers. However, we would like to know the details of every problematic deal, item or delivery, so we may consider disciplinary actions against an offending third-party seller who may have advertised on our Web Site. Please report any such case to our Help Center, giving full details about the advertisement, deal, item or items, and what exactly happened.
